Terms and Conditions of Use and Festival Attendance

BEAT Dance Festival (ABN 72 350 094 520) welcomes you to our website and our annual dance festival.

Please read these Terms and Conditions carefully before accessing our website, purchasing tickets or attending the festival.

By accessing our website, purchasing a ticket, or attending BEAT Dance Festival, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must refrain from using the website and purchasing tickets to the festival.

1. Acceptance of Terms

These Terms and Conditions apply to the use of the BEAT Dance Festival website (“the Website”), ticket purchases, festival attendance, participation in workshops and all associated activities.

BEAT Dance Festival reserves the right to amend or update these Terms and Conditions at any time. Updated versions will be published on the Website and become effective immediately upon publication.

Your continued use of the Website or attendance at the festival constitutes acceptance of any revised Terms and Conditions.

2. Intellectual Property

Unless otherwise stated, all content appearing on the Website, including logos, branding, graphics, photographs, videos, text, artwork, promotional material and digital content, remains the property of BEAT Dance Festival or its licensors and is protected under Australian intellectual property laws.

Content may be viewed or downloaded for personal, non-commercial use only.

No material may be copied, reproduced, modified, distributed, published or used for commercial purposes without the prior written consent of BEAT Dance Festival.

3. User Content

From time to time, BEAT Dance Festival may invite participants or attendees to submit photographs, videos, testimonials, comments or other material (“User Content”).

By submitting User Content, you confirm that:

  • you own the content or have permission to share it;

  • the content does not infringe another person’s rights;

  • the content is not defamatory, offensive or unlawful;

  • any identifiable person featured has given permission for their image to be shared.

You grant BEAT Dance Festival a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, edit, publish and promote your User Content across print, digital and social media platforms for promotional, educational and marketing purposes.

BEAT Dance Festival reserves the right to edit, refuse or remove any User Content at its sole discretion.

4. Website Information

While every reasonable effort is made to ensure information published on the Website is accurate and up to date, BEAT Dance Festival does not warrant that all information will always be complete, current or error free.

Workshop schedules, presenters, venues, ticket prices and festival information may change without notice.

5. Your Responsibilities

By using the Website or attending the festival, you agree to:

  • comply with all applicable Australian laws;

  • follow all directions given by BEAT Dance Festival staff and volunteers;

  • behave respectfully towards other attendees, presenters and venue staff;

  • refrain from behaviour that may endanger yourself or others;

BEAT Dance Festival reserves the right to:

  • update these Terms and Conditions;

  • modify or discontinue any part of the Website;

  • change workshop schedules or presenters;

  • refuse entry or remove any person who breaches these Terms and Conditions;

  • cancel or suspend services where necessary.

7. Children

The Website is intended for a general audience.

Participants under 18 years of age must have permission from a parent or legal guardian to attend BEAT Dance Festival.

Parents and guardians are responsible for determining whether festival content and workshops are appropriate for their child.

8. Disclaimer

Use of the Website is entirely at your own risk.

To the fullest extent permitted by law, BEAT Dance Festival excludes all warranties regarding the Website, its content and any linked third-party websites.

BEAT Dance Festival is not responsible for interruptions to the Website, technical issues or content published by third parties.

Nothing in these Terms excludes any rights that cannot legally be excluded under the Australian Consumer Law.

9. Governing Law

These Terms and Conditions are governed by the laws of New South Wales and the Commonwealth of Australia.

Any disputes arising in connection with these Terms and Conditions shall be subject to the jurisdiction of the courts of New South Wales.

10. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

11. Waiver

Failure by BEAT Dance Festival to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision or any other rights available to BEAT Dance Festival.

12. Festival Details

Event: BEAT Dance Festival

Venue: Cavanbah Centre, Byron Bay, New South Wales

Festival Dates: Saturday 3 October and Sunday 4 October 2026

BEAT Dance Festival is a workshop-based dance event featuring classes presented by guest choreographers and industry professionals.

The published schedule is indicative only and may be amended where required.

Workshop presenters, timetables and class allocations are subject to change without prior notice where circumstances require.

13. Festival Admission and Accreditation

All tickets and accreditation issued by BEAT Dance Festival remain the property of BEAT Dance Festival.

Admission is only permitted with a valid ticket or accreditation issued by BEAT Dance Festival.

Tickets and accreditation may not be transferred, copied, altered or used by any person other than the original purchaser or registered attendee unless prior written approval has been provided by BEAT Dance Festival.

Any fraudulent, altered or duplicated ticket may be cancelled without notice and the holder may be refused entry.

14. Conditions of Entry

By entering the festival venue, you agree to comply with these Terms and Conditions, all venue rules and all reasonable directions provided by BEAT Dance Festival staff, volunteers and venue personnel.

BEAT Dance Festival reserves the right to refuse entry to, or remove from the festival, any person who:

  • behaves in an unsafe, abusive, threatening or disruptive manner;

  • is intoxicated or appears to be under the influence of alcohol or illegal drugs;

  • refuses to comply with reasonable directions;

  • causes damage to the venue or festival property;

  • places the safety or enjoyment of others at risk;

  • breaches these Terms and Conditions.

Any person refused entry or removed from the festival will not be entitled to a refund.

15. Participant Responsibilities

All attendees are expected to contribute to a safe, respectful and inclusive environment.

Attendees agree to:

  • treat fellow dancers, choreographers, staff, volunteers and venue personnel with courtesy and respect;

  • participate safely and within their own physical capabilities;

  • follow all safety instructions during workshops;

  • notify festival staff of any injury, illness or emergency as soon as reasonably possible;

  • supervise children in their care when they are not participating in scheduled workshops.

Participants acknowledge that dance is a physical activity and accept responsibility for participating at a level appropriate to their own ability and health.

16. Personal Property

Attendees are responsible for the security of their own belongings at all times.

BEAT Dance Festival accepts no responsibility for lost, stolen or damaged personal property, including but not limited to clothing, footwear, electronic devices, valuables, dance equipment or vehicles.

17. Health and Safety

Dance workshops involve physical activity and carry an inherent risk of injury.

By attending BEAT Dance Festival, you acknowledge that you are physically capable of participating in dance activities and accept the risks associated with participation, including but not limited to:

  • slips, trips and falls;

  • muscular strains and sprains;

  • fatigue;

  • accidental contact with other participants;

  • existing injuries becoming aggravated.

If you have a medical condition that may affect your participation, you are responsible for seeking appropriate medical advice before attending.

Participants should immediately notify a member of the BEAT Dance Festival team if they become injured or unwell during the event.

18. Photography, Video and Media Consent

BEAT Dance Festival will capture photographs and video throughout the event for promotional, marketing, educational and archival purposes.

By attending the festival, you consent to your image, voice and likeness being photographed, filmed or recorded and grant BEAT Dance Festival permission to use this content in any media worldwide, including but not limited to:

  • social media;

  • websites;

  • promotional campaigns;

  • advertising;

  • printed publications;

  • future festival promotions.

No payment or compensation will be provided for such use.

If you have concerns regarding photography for exceptional privacy or safety reasons, you should notify BEAT Dance Festival in writing before the commencement of the event. While every reasonable effort will be made to accommodate requests, BEAT Dance Festival cannot guarantee that incidental capture in crowd photography or video will not occur.

19. Recording During Workshops

Participants and spectators are welcome to take photographs and short personal videos during designated times, provided doing so does not interfere with workshops or other attendees.

Professional cameras, drones, commercial filming or recording for business purposes are not permitted without prior written approval from BEAT Dance Festival.

Guest choreographers may request that choreography or class material not be recorded. These requests must be respected.

20. Festival Schedule

Workshop times, presenters, class allocations and the published program are subject to change without notice.

Where circumstances beyond the control of BEAT Dance Festival arise, presenters may be substituted or workshops amended.

Such changes do not entitle attendees to a refund.

21. Behaviour Expectations

BEAT Dance Festival is committed to providing a positive, welcoming and inclusive environment.

Bullying, harassment, discrimination, intimidation, abusive language or inappropriate behaviour towards attendees, choreographers, volunteers, staff or venue personnel will not be tolerated.

BEAT Dance Festival reserves the right to immediately remove any attendee whose behaviour is considered inappropriate or unsafe.

Removal from the festival under these circumstances will not result in a refund.

22. Assumption of Risk

By attending or participating in BEAT Dance Festival, you acknowledge that dance workshops and related activities involve physical exertion and carry inherent risks.

These risks may include, but are not limited to:

  • slips, trips and falls;

  • muscle strains and sprains;

  • physical contact with other participants;

  • aggravation of existing injuries or medical conditions;

  • equipment failure;

  • exposure to varying weather conditions when travelling to or from the venue.

You voluntarily assume all risks associated with your attendance and participation.

23. Release of Liability

To the fullest extent permitted by law, BEAT Dance Festival, its organisers, employees, contractors, volunteers, presenters and representatives are not liable for any injury, illness, loss, damage, expense or claim arising from your attendance or participation in the festival.

Nothing contained within these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.

24. Medical Emergencies

If an accident, injury or medical emergency occurs during the festival, you authorise BEAT Dance Festival staff to arrange first aid treatment or emergency medical assistance where reasonably necessary.

Any costs associated with medical treatment, ambulance transport or hospital care remain the responsibility of the participant or their parent or guardian.

25. Parent or Guardian Consent

Participants under 18 years of age must have a parent or legal guardian purchase their ticket or otherwise provide consent for attendance

By registering a participant under the age of 18 years, the parent or guardian confirms that they:

  • have read and accepted these Terms and Conditions;

  • consent to the participant attending BEAT Dance Festival;

  • accept the inherent risks associated with participation in dance workshops;

  • agree to be bound by these Terms and Conditions on behalf of the participant.

26. Tickets

All tickets remain the property of BEAT Dance Festival until the conclusion of the event.

Tickets must not be copied, altered, resold for commercial gain or otherwise misused without prior written consent.

Entry may be refused where a ticket is suspected to be fraudulent, duplicated, altered or otherwise invalid.

Proof of purchase may be requested at any time.

27. Ticket Policy

Unless otherwise required under the Australian Consumer Law:

  • All ticket sales are final.

  • Tickets are non-refundable.

  • Tickets are non-transferable unless approved in writing by BEAT Dance Festival.

  • Refunds will not be provided due to illness, injury, change of mind, scheduling conflicts, travel delays, adverse weather affecting travel, or any other personal circumstance preventing attendance.

Please ensure you carefully review your purchase before completing your booking.

28. Event Changes

BEAT Dance Festival reserves the right to amend:

  • workshop schedules;

  • class durations;

  • presenter line-ups;

  • venues within the festival location;

  • class capacities;

  • event timings.

Where a guest choreographer becomes unavailable due to circumstances beyond our control, BEAT Dance Festival may appoint an alternative presenter without liability.

Such changes do not constitute grounds for a refund.

29. Event Cancellation

If BEAT Dance Festival is cancelled due to circumstances within the organiser’s control, attendees will be notified as soon as reasonably practicable.

Where refunds are required by law, they will be processed using the original payment method wherever possible.

BEAT Dance Festival’s liability is limited to the amount paid for the original ticket unless otherwise required by law.

30. Force Majeure

BEAT Dance Festival will not be liable for any delay, cancellation or interruption caused by circumstances beyond its reasonable control, including but not limited to:

  • natural disasters;

  • severe weather events;

  • government restrictions;

  • venue closures;

  • industrial action;

  • pandemics or public health emergencies;

  • acts of terrorism;

  • power failures;

  • transport disruptions.

Where possible, reasonable efforts will be made to reschedule affected activities.

31. Privacy

BEAT Dance Festival respects your privacy and is committed to protecting your personal information.

Personal information collected may include:

  • name;

  • email address;

  • phone number;

  • emergency contact details;

  • date of birth (where required);

  • ticket purchase information;

  • photographs or video captured during the event.

This information is collected for the purposes of:

  • administering registrations;

  • communicating festival information;

  • ensuring participant safety;

  • responding to enquiries;

  • improving future events;

  • complying with legal obligations.

Your personal information will not be sold to third parties.

Any property found during the festival should be handed to Festival Administration.

While reasonable efforts will be made to reunite lost items with their owners, BEAT Dance Festival accepts no responsibility for lost, stolen or unclaimed property.

Unclaimed items may be disposed of after a reasonable period.


36. Reporting Concerns

If you believe any content published on the BEAT Dance Festival website or social media platforms breaches these Terms and Conditions, or if you have concerns regarding behaviour during the festival, please notify a member of the BEAT Dance Festival team as soon as possible.

All reports will be handled respectfully and confidentially where appropriate.

BEAT Dance Festival may amend these Terms and Conditions from time to time where reasonably necessary.

The most current version will always be published on the official BEAT Dance Festival website.

Continued use of the website or attendance at the festival constitutes acceptance of the updated Terms and Conditions.

39. Entire Agreement

These Terms and Conditions constitute the entire agreement between BEAT Dance Festival and all attendees, participants, parents, guardians and ticket purchasers in relation to the use of the website and attendance at the festival.

They replace any previous versions, discussions or representations relating to the matters covered by these Terms and Conditions.

43. Definitions

For the purposes of these Terms and Conditions:

Festival means BEAT Dance Festival conducted at the Cavanbah Centre, Byron Bay, New South Wales.

Participant means any person attending or taking part in workshops or activities conducted during the festival.

Attendee includes participants, spectators, parents, guardians, volunteers, presenters and ticket holders.

Website means the official BEAT Dance Festival website and any associated online registration platform.

44. Acceptance

By:

  • accessing the BEAT Dance Festival website;

  • purchasing a ticket;

  • registering for a workshop;

  • attending the festival; or

  • accompanying a participant to the festival,

you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions.

If you are purchasing tickets on behalf of another person or a participant under the age of 18 years, you confirm that you have authority to accept these Terms and Conditions on their behalf.
